လေးစားအပ်ပါသော အပြည်ပြည်ဆိုင်ရာတရားရုံး ဥက္ကဋ္ဌကြီး၊ ဂုဏ်သရေရှိ ဒုတိယဥက္ကဋ္ဌကြီး များနှင့် တရားသူကြီးမင်းများ ခင်ဗျား –

၁။ ပြည်ထောင်စုသမ္မတမြန်မာနိုင်ငံတော်ရဲ့ ကိုယ်စားလှယ်တစ်ဦးအနေနဲ့ မိမိတို့နိုင်ငံအပေါ် လူမျိုးသုဉ်းသတ်ဖြတ်မှုသဘောတူစာချုပ်ကို ချိုးဖောက်တယ်ဆိုတဲ့ စွပ်စွဲချက်ကို ခုခံကာကွယ်ဖို့ ကျွန်တော့်အနေနဲ့ ဤတရားရုံးတော်ရှေ့မှောက်မှာ ရောက်ရှိနေခြင်း ဖြစ်ပါတယ်။
၂။ မြန်မာနိုင်ငံဟာ လူမျိုးသုဉ်းသတ်ဖြတ်မှုသဘောတူစာချုပ်ရဲ့ အခြေခံကျတဲ့အရေးပါမှုကို အပြည့်အဝ အသိအမှတ်ပြုပါတယ်။ မြန်မာနိုင်ငံဟာ စာချုပ်ကို ၁၉၄၉ ခုနှစ်မှာ လက်မှတ်ရေးထိုးခဲ့ပြီး ၁၉၅၆ ခုနှစ်မှာ အတည်ပြုပါဝင်ခဲ့ပါတယ်။ ဤတရားရုံးတော်ခန်းမသို့ မြန်မာနိုင်ငံအနေဖြင့် ရောက်ရှိလာခြင်းဟာ မိမိတို့နိုင်ငံအတွက် ဤသဘောတူစာချုပ်ရဲ့ အရေးပါမှုကို သက်သေထူခြင်း ဖြစ်ပါတယ်။ ယနေ့မှာ ကျွန်တော်တို့ဟာ မိမိတို့နိုင်ငံရဲ့ ဂုဏ်သိက္ခာအပေါ် အလွန်ကြီးလေးသော စွပ်စွဲချက်တစ်ခုဖြစ်တဲ့ လူမျိုးသုဉ်းသတ်ဖြတ်မှုဟူသော စွပ်စွဲချက်မှ နိုင်ငံ၏ဂုဏ်သိက္ခာကို ကာကွယ်ရန် တရားရုံးတော်ရှေ့သို့ ရောက်ရှိနေခြင်း ဖြစ်ပါတယ်။ လူမျိုးသုဉ်းသတ်ဖြတ်မှုဟာ “ရာဇဝတ်မှုများထဲတွင် အဆိုးဝါးဆုံး ရာဇဝတ်မှု” (Crime of Crimes) ဖြစ်ပါတယ်။ ထို့ကြောင့် နိုင်ငံနှင့် ပြည်သူများအပေါ် ထိုကဲ့သို့သော ဖျက်မရနိုင်တဲ့ အမည်းစက်မျိုး အတင်မခံရစေရေး ကာကွယ်ရန်မှာ အစိုးရ၏တာဝန် ဖြစ်ပါတယ်။
၃။ မြန်မာနိုင်ငံသည် စွပ်စွဲချက်များနှင့် ဤအမှုကို အလေးအနက်ထား ဆောင်ရွက်ပါတယ်။ မြန်မာနိုင်ငံဟာ ကုလသမဂ္ဂရဲ့ အမြင့်ဆုံးတရားစီရင်ရေးအဖွဲ့ဖြစ်တဲ့ ဤတရားရုံးကို အထူး အလေးထားပါတယ်။ အပြည်ပြည်ဆိုင်ရာဥပဒေကို လိုက်နာရန် အပြည့်အဝကတိပြုထားတဲ့ အချုပ် အခြာအာဏာပိုင်နိုင်ငံတစ်နိုင်ငံအနေဖြင့် ယခုကဲ့သို့ ပြင်းထန်စွပ်စွဲချက်များကို တုံ့ပြန်ရန်အတွက် ချေပချက်များကို သေချာစွာပြင်ဆင်ထားပါတယ်။ တရားရုံးရဲ့ ပြဋ္ဌာန်းချက်များ (Statute)၊ လုပ်ထုံးလုပ်နည်းများ (Rules of Court) နှင့် ညွှန်ကြားချက်များကို လိုက်နာဆောင်ရွက်ခဲ့ပါတယ်။ တရားရုံးက သတ်မှတ်ပေးထားတဲ့အချိန်ကာလများကိုလည်း အတိအကျလိုက်နာခဲ့ပါတယ်။ တရားရုံးက ချမှတ်ထားတဲ့ ကြားဖြတ်စီမံဆောင်ရွက်မှုများ (Provisional Measures) အကောင်အထည်ဖော်မှု အစီရင်ခံစာများကို ပုံမှန်တင်သွင်းခဲ့ပါတယ်။ နိုင်ငံရဲ့ဂုဏ်သိက္ခာနဲ့ အနာဂတ်အတွက် အခြေခံကျတဲ့ ဤတရားစီရင်ရေးလုပ်ငန်းစဉ်များတွင် တာဝန်သိစွာဖြင့် ဆောင်ရွက်ခဲ့ပါတယ်။ ဤသည်မှာ အပြည်ပြည်ဆိုင်ရာတရားဥပဒေစိုးမိုးရေးနဲ့ စနစ်အတွင်း တရားရုံးရဲ့အခန်းကဏ္ဍကို မြန်မာနိုင်ငံက အလေးအနက် ကတိပြုထားကြောင်း ပြသခြင်းပင် ဖြစ်ပါတယ်။
၄။ ဂမ်ဘီယာနိုင်ငံအနေဖြင့် ထိုကဲ့သို့ အလေးထားဆောင်ရွက်ခြင်းမရှိသည်ကို စိတ်မကောင်းစွာ တွေ့ရပါတယ်။ ဂမ်ဘီယာနိုင်ငံဟာ ဤအမှုရဲ့ ဖြစ်ရပ်မှန်များနှင့် တိုက်ရိုက်သက်ဆိုင်သူ မဟုတ်သော်လည်း လူမျိုးသုဉ်းသတ်ဖြတ်မှုသဘောတူစာချုပ်တွင်ပါဝင်တဲ့ “နိုင်ငံအားလုံး၏ တူညီသော အကျိုးစီးပွား”အတွက် ဆောင်ရွက်ခြင်းဖြစ်တယ်လို့ ဆိုပါတယ်။ သို့သော် ၎င်းအနေနဲ့ တရားရုံး ရှေ့မှောက်မှာ အမှုရင်ဆိုင်နေတဲ့ အဖွဲ့အစည်းတစ်ခုအနေဖြင့် လိုက်နာရမယ့် အခြေခံ လိုအပ်ချက်များကိုပင် ပြည့်မီအောင် ဆောင်ရွက်နိုင်ခြင်း မရှိသည်ကို တွေ့ရပါတယ်။
၅။ ဂမ်ဘီယာက တင်သွင်းတဲ့ အချက်အလက်များနဲ့ ရှာဖွေစုံစမ်းမှုများဟာ သာမန် အချက်အလက်များသာဖြစ်ပြီး ဘက်လိုက်မှုရှိကြောင်းကို မြန်မာဥပဒေအဖွဲ့က သက်သေပြသွားမှာ ဖြစ်ပါတယ်။ အချက်အလက်ရှာဖွေရေးအဖွဲ့ (FFM) ရဲ့ ၂၀၁၈ ခုနှစ်က ကောက်ချက်များအပေါ် အခြေခံပြီး ဒီအမှုကို ဂမ်ဘီယာက တင်သွင်းခဲ့ခြင်း ဖြစ်ပါတယ်။ ယုံကြည်စိတ်ချရမှုမရှိသည့်အပြင် ဘက်လိုက်မှုရှိတဲ့ အရင်းအမြစ်ကိုသာ ဆက်လက်၍ ကိုးကားနေပါတယ်။ ထိုကဲ့သို့ ကိုးကားတင်သွင်းခြင်းဟာ မြန်မာနိုင်ငံအပေါ် တရားစီရင်မှုမပြုမီ ကြိုတင်ပြစ်ဒဏ်ခတ်ခြင်းသာ ဖြစ်ပါတယ်။ ၂၀၁၉ ခုနှစ်ကတည်းက ဂမ်ဘီယာဟာ (FFM) ရဲ့ အစီရင်ခံစာများက သက်သေ အထောက်အထားများမှာ ခိုင်မာတဲ့အထောက်အထားများဖြစ်အောင် ကြိုးပမ်းခဲ့ခြင်းမရှိပါ။ ၎င်းတို့သည် ထိုအစီရင်ခံစာများကိုသာ အမှန်တရားများအဖြစ် ဆက်လက်စွဲကိုင်နေပြီး တရားရုံးမှ လက်ခံပေးရန် တောင်းဆိုနေပါတယ်။
၆။ ထို့အပြင် တရားရုံးရှေ့မှောက်တွင် ရိုးသားဖြောင့်မတ်စွာ လိုက်နာရမည့် (Good faith) တာဝန်ကို ပစ်ပယ်၍ ဂမ်ဘီယာဟာ သတင်းအရင်းအမြစ်များမှ အချက်အလက်များကို လိုအပ်သလို ပြင်ဆင်မှုများ ပြုလုပ်ခဲ့ပါတယ်။ ရှေ့နေများနှင့် သက်သေများကို အတူတကွထားရှိပြီး ကိုယ်စားလှယ်အဖွဲ့ဝင်များတွင် NGOs အဖွဲ့ဝင်များ ပါဝင်နေခြင်းဟာ အမှုအတွက် ရောထွေးမှုများကို ဖြစ်စေခဲ့ပါတယ်။ ဤသည်မှာ တရားစီရင်ရေးလုပ်ငန်းစဉ်ရဲ့ ဂုဏ်သိက္ခာကို အထောက်အကူ မပြုနိုင်သည့်အပြင် ဂမ်ဘီယာဘက်က တင်ပြလာတဲ့ အထောက်အထားများရဲ့ ခိုင်မာမှုကို ကြီးစွာသံသယဖြစ်စေပါတယ်။

ဥက္ကဋ္ဌကြီးနှင့် တရားသူကြီးမင်းများ ခင်ဗျား

၇။ လူမျိုးသုဉ်းသတ်ဖြတ်မှုစွပ်စွဲချက်ကို ယခုလို စနစ်ကျနမှုမရှိ၊ သတ်မှတ်သည့်စံနှုန်းများနဲ့လည်း ကိုက်ညီမှုမရှိဘဲ ကိုင်တွယ်ရသည်မှာ အလွန်ပင်စိုးရိမ်စရာ ဖြစ်ပါတယ်။ အဆုံးသတ်မှာတော့ တရားရုံးတော်အနေနဲ့ အရေးကြီးတဲ့ မေးခွန်းတစ်ခုကို ဖြေကြားရမှာ ဖြစ်ပါတယ်။ ယင်းမေးခွန်း ကတော့ “၂၀၁၆ ခုနှစ်နှင့် ၂၀၁၇ ခုနှစ်များအတွင်း ရခိုင်ပြည်နယ်မြောက်ပိုင်းတွင် ဆောင်ရွက်ခဲ့တဲ့ စစ်ဆင်ရေးများအတွင်း မြန်မာနိုင်ငံဟာ အုပ်စုတစ်ခု၏ တစ်စိတ်တစ်ပိုင်းကိုဖြစ်စေ၊ အုပ်စုတစ်ခုလုံးကို ဖြစ်စေ ဖျက်ဆီးလိုသောရည်ရွယ်ချက်နဲ့ လူမျိုးသုဉ်းစေမှုသဘောတူစာချုပ်ကို ဆန့်ကျင်၍ ဆောင်ရွက်ခဲ့ခြင်း ရှိ/ မရှိ” ဆိုတဲ့အချက် ဖြစ်ပါတယ်။ ဂမ်ဘီယာအနေနဲ့ အမှုနဲ့ဆက်စပ်နေသော သက်သေပြရန်တာဝန်ကို ဆောင်ရွက်နိုင်ခြင်း မရှိကြောင်း မြန်မာနိုင်ငံက ခိုင်မာစွာ ထုတ်ဖော်ပြသလိုပါတယ်။ မြန်မာနိုင်ငံအနေဖြင့် သက်သေပြရန် တာဝန်မရှိသော်လည်း ဂမ်ဘီယာရဲ့ သက်သေအထောက်အထားများ ခိုင်မာမှု ရှိ/ မရှိ နဲ့ပတ်သက်ပြီး ရှင်းရှင်းလင်းလင်း ထောက်ပြနိုင်ခဲ့ ပါတယ်။ ဂမ်ဘီယာနိုင်ငံရဲ့ အတည်မပြုနိုင်တဲ့ တစ်ဆင့်စကားများနဲ့ ဘယ်သူထွက်ဆိုလို့ ထွက်ဆိုထားမှန်း မသိတဲ့ သက်သေထွက်ဆိုချက်များအပေါ် အသိအမှတ်ပြု ဆောင်ရွက်မည်ဆိုပါက ချေပရန် အခက်အခဲဖြစ်စေမှာဖြစ်ပါတယ်။

ဥက္ကဋ္ဌကြီးနှင့် တရားသူကြီးမင်းများ ခင်ဗျား

၈။ ဒီအမှုဟာ အခြေအမြစ်မရှိသော စွပ်စွဲချက်များထက် ခိုင်လုံသော၊ သက်သေပြနိုင်သော အချက်အလက်များပေါ်တွင်သာ မူတည်ပါတယ်။ တိကျခိုင်မာသောအချက်အလက်များကို စိတ်ထိခိုက်လှုပ်ရှားဖွယ်စကားလုံးများနဲ့ အချက်အလက်ခိုင်မာမှုမရှိတဲ့ သရုပ်ဖော်ပြောကြားမှုများနဲ့ အစားထိုးနိုင်မည် မဟုတ်ပါ။ ဒီအမှုဟာ ဥပဒေရဲ့မှန်ကန်သော အဓိပ္ပာယ်ဖွင့်ဆိုခြင်းအပေါ် မူတည်နေပြီး ဂမ်ဘီယာရဲ့ အဓိပ္ပာယ်ဖွင့်ဆိုချက်များဟာ ရုံးတော်ရဲ့ ယခင်စီရင်ထုံးများကို လျစ်လျူရှုပြီး ဥပဒေရဲ့ အဓိပ္ပာယ်ဖွင့်ဆိုချက်ကို ၎င်းတို့ လိုရာဆွဲထားခြင်းဖြစ်ကြောင်းကို မိမိတို့ရဲ့ ရှေ့နေများက လျှောက်လဲတင်ပြသွားမှာဖြစ်ပါတယ်။
၉။ ဒီအမှုကို ဆုံးဖြတ်ရာမှာ ၂၀၁၆ ခုနှစ်နှင့် ၂၀၁၇ ခုနှစ်များအတွင်း ရခိုင်ပြည်နယ်မြောက်ပိုင်းမှာ ဖြစ်ပွားခဲ့တဲ့ အကြမ်းဖက်တိုက်ခိုက်မှုများကို ချန်လှပ်ထားလို့မရပါ။ အကြမ်းဖက်တိုက်ခိုက်မှုများ ကြောင့် “နယ်မြေရှင်းလင်းရေး” (Clearance Operations) များ ပြုလုပ်ခဲ့ရခြင်း ဖြစ်ပါတယ်။ ဒီနေရာမှာ အထူးရှင်းပြလိုတာကတော့ ဒီအသုံးအနှုန်းဟာ စစ်ဘက်ဆိုင်ရာအသုံးအနှုန်း (Term of military art) တစ်ခုသာဖြစ်ပြီး၊ သောင်းကျန်းမှုနှိမ်နင်းရေး သို့မဟုတ် အကြမ်းဖက်မှုတိုက်ဖျက်ရေး ဆောင်ရွက်ချက်များကို ရည်ညွှန်းပါတယ်။ ဒီအသုံးအနှုန်းကို ကမ္ဘာတစ်ဝှမ်းမှာ အသုံးပြုမှု ရှိပါတယ်။ ဂမ်ဘီယာအနေနဲ့ တိကျမှုမရှိတဲ့ အချက်အလက်များကို အခြေခံပြီး တရားရုံးကို ဆုံးဖြတ်ချက်ချစေရန် ကြိုးပမ်းနေပါတယ်။
၁၀။ ၂၀၁၆ ခုနှစ်နှင့် ၂၀၁၇ ခုနှစ် စစ်ဆင်ရေးများနှင့်ပတ်သက်လို့ ဂမ်ဘီယာက ARSA အကြမ်းဖက် အဖွဲ့၏ လုပ်ဆောင်ချက်များကို ငြင်းဆိုထားခြင်းမရှိသော်လည်း အစိုးရက လိုအပ်၍ တုံ့ပြန် ဆောင်ရွက်မှုများကိုမှု ငြင်းဆိုလိုတဲ့သဘောရှိပါတယ်။ သို့သော် မြန်မာနိုင်ငံအစိုးရအနေနဲ့ ရခိုင် ပြည်နယ်မြောက်ပိုင်းတွင် အကြမ်းဖက်သမားများကို စိတ်ကြိုက်ချယ်လှယ်ခွင့်ပေးထားသင့်တယ်လို့ ဂမ်ဘီယာက ဆိုလိုနေခြင်း မဟုတ်နိုင်ပါ။ တုံ့ပြန်ရာမှာ အင်အားအလွန်အကျွံ သုံးခဲ့တယ်လို့ ဂမ်ဘီယာက အဓိကပြောလိုခြင်းသာ ဖြစ်ပါတယ်။ အကယ်၍ အင်အားအလွန်အကျွံ သုံးခဲ့မည် ဆိုလျှင်ပင် လူမျိုးသုဉ်းစေမှု မြောက်မည်မဟုတ်ပါ။
၁၁။ ပဋိပက္ခများရဲ့ နောက်ဆက်တွဲအနေနဲ့ သေဆုံးမှုများ ရှိခဲ့ပြီး၊ လူအများအပြား ဘင်္ဂလားဒေ့ရှ် နိုင်ငံသို့ ထွက်ခွာသွားသည်မှာ အမှန်ပင်ဖြစ်ပါတယ်။ ကမ္ဘာတစ်ဝှမ်းရှိ အခြားသော လက်နက်ကိုင် ပဋိပက္ခများနှင့် မတည်ငြိမ်မှုများ၊ မြန်မာနိုင်ငံရဲ့ အခြားဒေသများတွင် ဖြစ်ပွားခဲ့တဲ့ ဖြစ်ရပ်များ ကဲ့သို့ပင် ဒေသခံပြည်သူများအပေါ် ကြီးမားတဲ့သက်ရောက်မှု ရှိခဲ့ပါတယ်။ လက်နက်ကိုင်ပဋိပက္ခ၊ ဒေသတွင်းမတည်ငြိမ်မှုနဲ့ အကြမ်းဖက်မှုများကြောင့် ဖြစ်ပေါ်လာတဲ့ ထိခိုက်သေဆုံးမှုများကို မြန်မာနိုင်ငံအနေဖြင့် ကောင်းစွာ သိရှိပြီးဖြစ်ပါတယ်။ မြန်မာနိုင်ငံ၏ အခြားဒေသများတွင်လည်း သမိုင်း တစ်လျှောက် လက်နက်ကိုင်ပဋိပက္ခများရှိခဲ့ပြီး ယနေ့အချိနိအထိလည်း ရှိနေဆဲဖြစ်ပါတယ်။ အစိုးရအနေဖြင့် တစ်နိုင်ငံလုံး ငြိမ်းချမ်းမှုရရှိရန်အတွက် ပါဝင်ပတ်သက်သူများအားလုံးနဲ့ ညှိနှိုင်းဆွေးနွေးမှုများကို အစွမ်းကုန် ကြိုးပမ်းဆောင်ရွက်လျက်ရှိပါတယ်။
၁၂။ သို့သော် ငြိမ်းချမ်းရေးဆီသို့ လျှောက်လှမ်းရာ လမ်းကြောင်းများဟာ ရှုပ်ထွေးပါတယ်။ ရခိုင် ပြည်နယ်မြောက်ပိုင်းရှိ မွတ်ဆလင်များအတွက် မည်ကဲ့သို့ ရှေ့ဆက်ရမည် သို့မဟုတ် မည်သည်တို့ကို မျှော်လင့်ရမည်စသည့်ကိစ္စရပ်များကို ယခုတရားရင်ဆိုင်နေသည့် ပြဿနာရပ်ရဲ့ ကျဉ်းမြောင်းသော အမြင်တစ်ခုတည်းနဲ့ တရားရုံးက ဆုံးဖြတ်ခြင်း မပြုနိုင်ပါ။ တရားရုံးအနေဖြင့် ၂၀၁၆ ခုနှစ်နှင့် ၂၀၁၇ ခုနှစ် အကြမ်းဖက်တိုက်ခိုက်မှုူများအတွက် တာဝန်ရှိသူများသည် ရခိုင်ပြည်နယ်မြောက်ပိုင်းရှိ မွတ်ဆလင်များကို ကိုယ်စားပြုသည်ဟု မမှတ်ယူနိုင်ပါ။ ထို့အတူ တရားရင်ဆိုင်ခြင်းတွင် ပါဝင်ပတ်သက်နေတဲ့ အဖွဲ့အစည်းများကလည်း ၎င်းတို့ကို ကိုယ်စားပြုသည်ဟု မမှတ်ယူနိုင်ပါ။
၁၃။ ဖွံ့ဖြိုးဆဲနိုင်ငံတစ်ခုဖြစ်သည့် မြန်မာနိုင်ငံအနေဖြင့် ငလျင်ဘေး၊ ရေဘေး၊ မုန်တိုင်းဘေး စတဲ့ သဘာဝဘေးအန္တရာယ်များအပြင် ဘဏ္ဍာရေးအကြပ်အတည်း၊ အရေးပေါ်အခြေအနေများနှင့် ပြည်တွင်းမတည်ငြိမ်မှုများစတဲ့ စိန်ခေါ်မှုများ ဆက်လက်ရင်ဆိုင်နေရပါတယ်။ အဆိုပါ အခြေအနေ များကြားမှ ရခိုင်ပြည်နယ်မြောက်ပိုင်း ကိစ္စရပ်များကို ဖြေရှင်းရန် စဉ်ဆက်မပြတ် ဆောင်ရွက်ခဲ့ပါတယ်။ အသေးစိတ်အချက်အလက်များကို တရားရုံးရဲ့ ကြားဖြတ်စီမံဆောင်ရွက်ချက် အမိန့်နဲ့အညီ မြန်မာနိုင်ငံက ပုံမှန်တင်သွင်းတဲ့အစီရင်ခံစာတွေမှာ တင်ပြခဲ့ပါတယ်။

၁၄။ ဂမ်ဘီယာက မြန်မာနိုင်ငံဟာ ရခိုင်ပြည်နယ်မြောက်ပိုင်းရှိ မွတ်ဆလင်များအပေါ် လူမျိုးသုဉ်း သတ်ဖြတ်မှုကျူးလွန်ခဲ့ပြီး မြန်မာနိုင်ငံက ၎င်းတို့ရဲ့တည်ရှိမှုနဲ့ မြန်မာနိုင်ငံမှာ နေထိုင်ခွင့်ကို အသိအမှတ်မပြုဘူးလို့ စွပ်စွဲထားပါတယ်။ ဒီစွပ်စွဲချက်ဟာ မှန်ကန်မှုမရှိပါ။ ၎င်းတို့ဟာ မြန်မာနိုင်ငံရဲ့ နယ်မြေအတွင်း နေထိုင်ခွင့်ရှိသူတွေဖြစ်ကြောင်းကို မြန်မာနိုင်ငံအနေနဲ့ အသိအမှတ်ပြုပါတယ်။ ရခိုင်ပြည်နယ်မြောက်ပိုင်းရှိ ဘင်္ဂါလီများဟာ တစ်ဖက်ဘင်္ဂလားဒေ့ရှ်နိုင်ငံ နယ်စပ်မှာ နေထိုင်သူများနဲ့ ယဉ်ကျေးမှု၊ လူမျိုး၊ ဘာသာရေးတို့အရ တူညီတဲ့အုပ်စုတစ်ခုအဖြစ် မြန်မာနိုင်ငံအနေနဲ့ မှတ်ယူပါတယ်။ ယင်းသို့တိုင်အောင် လူမျိုးသုဉ်းစေမှုဆိုင်ရာ စာချုပ်ရဲ့အဓိပ္ပာယ်အောက်မှာ မြန်မာနိုင်ငံအနေနဲ့ ၎င်းတို့ဟာ ထိုအုပ်စုဝင်ဖြစ်ကြောင်း လက်ခံပါတယ်။ တစ်နည်းအားဖြင့် တရားရုံးအနေနဲ့ ရခိုင်ပြည်နယ်မြောက်ပိုင်းမှာ နေထိုင်နေကြသူတွေဟာ စာချုပ်ရဲ့ အဓိပ္ပာယ် ကောက်ယူမှုအရ အကာအကွယ်ပေးထားတဲ့ အုပ်စုတစ်စုလို့ ဆုံးဖြတ်ခဲ့လျှင်ပင် ၎င်းတို့ရဲ့ ယဉ်ကျေးမှု၊ လူမျိုး၊ ဘာသာရေးတွေဟာ အိမ်နီးချင်း ဘင်္ဂလားဒေ့ရှ်နိုင်ငံနယ်မြေမှာ နေထိုင်နေသူတွေနဲ့ မတူကွဲပြားတယ်လို့ မမှတ်ယူနိုင်ပါ။ ဤအခြေခံဖြင့်ယူဆမယ်ဆိုရင် တရားရုံးအနေဖြင့် နယ်စပ်တစ်ဖက်တစ်ချက်မှာ နေထိုင်သူများရဲ့ ယဉ်ကျေးမှု၊ လူမျိုး၊ ဘာသာရေးတွေကို နှိုင်းယှဉ်သုံးသပ်ဖို့ လိုတော့မှာ မဟုတ်ပါဘူး။
၁၅။ ဂမ်ဘီယာက မြန်မာနိုင်ငံအနေနဲ့ “ရိုဟင်ဂျာ” ဟူသောအမည်ကို တရားဝင် အသုံးမပြုဘဲ “ဘင်္ဂါလီ”ဟုသာ အသုံးပြုတယ်လို့ ကန့်ကွက်ပါတယ်။ ဒါပေမဲ့ ဒီလိုသုံးနှုန်းရတာ ခိုင်လုံတဲ့ အကြောင်းပြချက်တွေ ရှိတယ်ဆိုတဲ့အချက်ကိုတော့ ဂမ်ဘီယာက မရှင်းပြခဲ့ပါ။ အုပ်စုတစ်ခုကို အမည်တစ်ခုတပ်ပြီး ခေါ်ဝေါ်သုံးစွဲမှု မပြုခြင်းဟာ ယင်းလူမျိုးများ ဖြစ်တည်မှု/ဖြစ်တည်ခွင့်မရှိဟု သော်လည်းကောင်း သို့မဟုတ် ဒီအုပ်စုကို ရုပ်ပိုင်းဆိုင်ရာ သို့မဟုတ် ဇီဝပိုင်းဆိုင်ရာ ဖျက်ဆီးရန် ရည်ရွယ်ချက်ရှိသည်ဟုသော်လည်းကောင်း မယူဆနိုင်ပါ။
၁၆။ ဂမ်ဘီယာက မြန်မာသည် ၎င်းအုပ်စုရဲ့ အဖွဲ့ဝင်များကို နိုင်ငံသားအဖြစ် အသိအမှတ်မပြုကြောင်းလည်း စွပ်စွဲထားပါတယ်။
၁၇။ ဒီကိစ္စဟာ တရားရုံးရှေ့မှောက်မှာရှိနေတဲ့ အမှုနဲ့ မသက်ဆိုင်သင့်ပါ။ လူမျိုးသုဉ်းစေမှုကို တားဆီးခြင်းဆိုင်ရာ စာချုပ်ဟာ စာချုပ်ဝင်နိုင်ငံတွေအပေါ် မည်သည့်အုပ်စုကို နိုင်ငံသား သတ်မှတ်ပေးပါလို့ ပြောကြားခွင့်မရှိပါဘူး။ နိုင်ငံသားဖြစ်မှုဆိုတာ သတ်မှတ်ထားတဲ့ စံနှုန်းများနဲ့ ပြည့်မီခြင်း ရှိ-မရှိအပေါ် မူတည်တဲ့ တစ်ဦးချင်းစီရဲ့ အခွင့်အရေးသာဖြစ်ပါတယ်။ အကာအကွယ် ပေးထားတဲ့ အုပ်စုဝင်ဖြစ်ခြင်း-မဖြစ်ခြင်းနဲ့ နိုင်ငံသားဖြစ်ခွင့် ရှိခြင်း-မရှိခြင်းတို့ဟာ သီးခြားကိစ္စတွေဖြစ်ပါတယ်။ အုပ်စုတစ်စုကို အလိုအလျောက်နိုင်ငံသားဖြစ်ခွင့် မပေးခြင်းဟာ ၎င်းတို့ တည်ရှိပိုင်ခွင့်မရှိဟုသော်လည်းကောင်း၊ ၎င်းတို့ကို ဖျက်ဆီးလိုခြင်းသော်လည်းကောင်း ဆိုလိုခြင်းမဟုတ်ပါ။
၁၈။ ယခုကိစ္စဟာ ဒီအမှုနဲ့ သက်ဆိုင်ခြင်းမရှိသော်လည်း ဂမ်ဘီယာရဲ့ ပြောဆိုချက်များဟာ မမှန် ကြောင်း ကျွန်တော်အနေနဲ့ အလေးပေးပြောကြားလိုပါတယ်။ အမှန်တကယ်မှာတော့ ဘင်္ဂါလီအများ အပြားဟာ မြန်မာနိုင်ငံရဲ့ နိုင်ငံသားအမျိုးအစား သုံးမျိုးအနက် တစ်မျိုးမျိုး ရရှိထားကြပါတယ်။ တစ်ချို့ကလည်း နိုင်ငံသားဖြစ်ခွင့် လျှောက်ထားရန် သတ်မှတ်ချက်နဲ့ ကိုက်ညီသူများ ဖြစ်ကြပါတယ်။ တချို့ကတော့ မြန်မာနိုင်ငံရဲ့ နိုင်ငံသားဖြစ်ခွင့် စံနှုန်းများနဲ့ မကိုက်ညီကြသူများဖြစ်ပါတယ်။ ဒီလို ဖြစ်ရတာလဲ အကြောင်းရင်းများ ရှိပါတယ်။
၁၉။ နိုင်ငံသားဖြစ်ခွင့် လျှောက်ထားသူများအတွက် ပထမအဆင့်ဟာ နိုင်ငံသားစိစစ်မှုခံယူမည့် ကတ်ပြား (NVC) ကို လျှောက်ထားရမှာဖြစ်ပါတယ်။ ယခုအခါ နိုင်ငံအတွင်းမှာ နိုင်ငံသားစိစစ်ရေး ကတ်ကိုင်ဆောင်သူ နှစ်သိန်းနီးပါးနဲ့ ရခိုင်ပြည်နယ်အတွင်း နိုင်ငံသားစိစစ်မှုခံယူမည့် ကတ်ပြား (NVC) ကိုင်ဆောင်သူ ငါးသောင်းနီးပါးရှိပါတယ်။ သို့ပေမဲ့ NVC ကတ်လျှောက်ထားပြီး နိုင်ငံသားဖြစ်ရန် အရည်အချင်းမပြည့်မီသူများအနေနဲ့လည်း NVC ကတ် ကိုင်ဆောင်သူများအနေနဲ့ မြန်မာနိုင်ငံ အတွင်းမှာ ဥပဒေနဲ့အညီ ဆက်လက်နေထိုင်ခွင့်ရမှာဖြစ်ပါတယ်။
၂၀။ ဒါပေမဲ့လည်း ရခိုင်ပြည်နယ်မြောက်ပိုင်းရှိ ဘင်္ဂါလီအများအပြားဟာ NVC လုပ်ငန်းစဉ်မှာ ပါဝင်ဆောင်ရွက်ဖို့ ငြင်းဆန်ကြပါတယ်။ အချို့က ဘင်္ဂါလီများကို လျှောက်ထားရန်မလိုဘဲ အလိုအလျောက် နိုင်ငံသားဖြစ်ခွင့်ပေးသင့်တယ်ဆိုတဲ့ နိုင်ငံရေးအကြောင်းပြချက်နဲ့ ငြင်းကြပါတယ်။ အချို့က တက်ကြွလှုပ်ရှားသူများရဲ့ ဖိအားပေးမှုကြောင့် ငြင်းဆန်ကြပါတယ်။ အချို့က NVC လျှောက်ထားသူတိုင်းဟာ နိုင်ငံသားဖြစ်ခွင့်မရတော့ကြောင်း တက်ကြွလှုပ်ရှားသူများရဲ့ သတင်းမှားတွေကြောင့် ငြင်းဆန်ကြပါတယ်။ ဒီအချက်အားလုံးဟာ လူမျိုးသုဉ်းစေမှုနဲ့ မည်သို့မှ မသက်ဆိုင်ပါ။
၂၁။ အခြားနိုင်ငံများနည်းတူ မြန်မာနိုင်ငံ ဖွဲ့စည်းပုံအခြေခံဥပဒေဟာ မြန်မာနိုင်ငံသား အားလုံးအပေါ် အခွင့်အရေးတန်းတူပေးထားပါတယ်။ ၎င်းတို့ရဲ့ ဇစ်မြစ်ကြောင့်လည်းကောင်း၊ ယုံကြည်မှုကြောင့်လည်းကောင်း မည်သူ့အပေါ်မှ နိုင်ငံရေးအရ ခွဲခြားဆက်ဆံခြင်းမရှိပါ။ ဖွဲ့စည်းပုံအခြေခံ ဥပဒေပုဒ်မ (၃၉၁-က)အရ အရည်အချင်းပြည့်မီသော နိုင်ငံသားတိုင်း မဲပေးခွင့် ရရှိပါတယ်။ ယင်းတို့အထဲတွင် လက်ရှိ ရွေးကောက်ပွဲများမှာ မဲပေးရန် အရည်အချင်းပြည့်မီသော ဘင်္ဂါလီများ ၁၅၄၀၄၉ ဦးရှိပါတယ်။
၂၂။ ယခုအခါ မြန်မာနိုင်ငံမှာ အထွေထွေရွေးကောက်ပွဲတစ်ရပ်ကို ၂၈-၁၂-၂၀၂၅ ရက်မှစ၍ အဆင့် သုံးဆင့်ခွဲကာ ကျင်းပလျက်ရှိပြီး၊ ရွေးကောက်ပွဲတွင် လူမျိုးမရွေး၊ ဘာသာမရွေး မဲပေးပိုင်ခွင့်ရှိသည့် ပြည်သူများ လာရောက်မဲပေးခဲ့ကြပါတယ်။ နိုင်ငံရေးပါတီ (၅၇)ပါတီနဲ့ လွှတ်တော် ကိုယ်စားလှယ်လောင်း (၄၈၆၁) ဦးတို့နှာ ရခိုင်ပြည်နယ်အပါအဝင် မဲဆန္ဒနယ်ပေါင်းစုံမှာ ပါဝင်ယှဉ်ပြိုင်လျက်ရှိပါတယ်။
၂၃။ လက်ရှိ ဘင်္ဂလားဒေ့ရှ်နိုင်ငံကို ရောက်ရှိနေတဲ့ ရခိုင်ပြည်နယ်မြောက်ပိုင်းတွင် နေထိုင်သူများကို အောင်မြင်စွာ ပြန်လည်လက်ခံနိုင်ရေးအတွက် သန္နိဋ္ဌာန်ချထားပါတယ်ဆိုတာကို ရှင်းလင်းစွာ ပြောကြားလိုပါတယ်။
၂၄။ မြန်မာဘက်မှ ဘင်္ဂလားဒေ့ရှ်ဘက်သို့ ၁၉၇၈ ခုနှစ်နဲ့ ၁၉၉၂ ခုနှစ်တို့တွင် လူအများအပြား ထွက်ခွာမှုရှိခဲ့ပါတယ်။ (၂)ကြိမ်စလုံးမှာ နှစ်နိုင်ငံသဘောတူ ညှိနှိုင်းချက်များဖြင့် မြန်မာဘက်မှ ပြန်လည်လက်ခံနိုင်ခဲ့ပါတယ်။
၂၅။ ထို့အတူ ၂၀၁၆ နဲ့ ၂၀၁၇ ဖြစ်စဉ်များနောက်ပိုင်း ရခိုင်ပြည်နယ်မှ နေရပ်စွန့်ခွာသူများ ပြန်လည် လက်ခံရေးအတွက် မြန်မာ-ဘင်္ဂလားဒေ့ရှ်နိုင်ငံအကြား လျင်မြန်စွာ သဘောတူညီချက်များ ပြုလုပ်နိုင်ခဲ့ပြီး၊ ကုလသမဂ္ဂအပါအဝင် နိုင်ငံတကာပူးပေါင်းဆောင်ရွက်မှုများဖြင့် ပြန်လည် ဝင်ရောက်လာသူများကို ပြန်လည်လက်ခံနေရာချထားရေး၊ လုံခြုံရေး၊ ပညာရေး၊ ကျန်းမာရေး၊ စားနပ်ရိက္ခာနဲ့ အလုပ်အကိုင် ဖော်ဆောင်ရေးအပါအဝင် အစစအရာရာ ပြင်ဆင် ဆောင်ရွက်ထားခဲ့ပါတယ်။
၂၆။ ၂၀၁၉ ခုနှစ်မှစ၍ နေရပ်စွန့်ခွာသူများ ပြန်လည်လက်ခံရေးလုပ်ငန်းစဉ်အတွက် မြန်မာ၊ ဘင်္ဂလားဒေ့ရှ်နဲ့ တရုတ်နိုင်ငံတို့မှ လုပ်ငန်းအဆင့် သုံးပွင့်ဆိုင် အလွတ်သဘောဆွေးနွေးပွဲများ အဆင့်မြင့်အရာရှိကြီးများအဆင့်နဲ့ ဒုတိယဝန်ကြီးအဆင့် အလုပ်ရုံဆွေးနွေးပွဲများ ပြုလုပ်ခဲ့ပါတယ်။ နေရပ်စွန့်ခွာသူများ ပြန်လည်လက်ခံရေးအတွက် ဆောင်ရွက်ထားသည့် အခြေအနေများကိုလည်း သံတမန်များ၊ နေရပ်စွန့်ခွာသူ ကိုယ်စားလှယ်များနဲ့ ပြည်တွင်း၊ ပြည်ပ မီဒီယာများကို ဖိတ်ကြားပြသရှင်းလင်းခဲ့ပါတယ်။ ထို့ပြင် NV ကတ် ထုတ်ပေးရေးနဲ့ နိုင်ငံသား လျှောက်ထားနိုင်ရေးအတွက် one stop service ဝန်ဆောင်မှု အပါအဝင် ရောက်ရှိလာသူများအတွက် ဘက်ပေါင်းစုံ ပြန်လည်နေရာချထားရေးနဲ့ ပြန်လည်ထူထောင်ရေး လုပ်ငန်းစဉ်များဖြစ်သည့် ယာယီအသက်မွေးဝမ်းကြောင်း အထောက်အကူပြုပစ္စည်းများနဲ့ ယာယီတည်းခိုရန်နေရာများ၊ ယခင်နေထိုင်ခဲ့သည့် မူလနေရာများနဲ့ အနီးဆုံးနေရာများတွင် နေထိုင်နိုင်ရေးအစီအမံများ၊ လယ်ယာစိုက်ပျိုးနိုင်ရေးအတွက် မြေများ ခွဲဝေချထားရေးအစီအစဉ်များ ဝင်ငွေရရှိနိုင်မည့် အစီအစဉ်များ၊ ဆေးဝါးကုသရေးနှင့် ပညာသင်ကြားရေးဆိုင်ရာနေရာများ စီစဉ်ထားရှိပါတယ်။
၂၇။ မြန်မာနိုင်ငံအနေဖြင့် အစွမ်းကုန်ကြိုးစားဆောင်ရွက်ခဲ့သော်လည်း ၂၀၂၀ ပြည့်နှစ်မှ ၂၀၂၂ ခုနှစ်အတွင်း ဖြစ်ပွားခဲ့သော ကိုဗစ်-၁၉ ကပ်ရောဂါကြောင့်လည်းကောင်း၊ ၂၀၂၃ ခုနှစ်၊ ရခိုင်ပြည်နယ် မြောက်ပိုင်းတွင် တိုက်ခတ်ခဲ့သော ဆိုင်ကလုံးမုန်တိုင်း မိုခါကြောင့်လည်းကောင်း၊ အဆိုပါဒေသ အတွင်းမှာတွင်ပင် ဖြစ်ပွားခဲ့သော နယ်မြေလုံခြုံရေး မတည်ငြိမ်မှုများကြောင့်လည်းကောင်း အမျိုးမျိုးသော အကြောင်းတရားများကြောင့် နေရပ်စွန့်ခွာသူများ ပြန်လည်လက်ခံရေး လုပ်ငန်းစဉ်မှာ နှောင့်နှေး ကြန့်ကြာခဲ့ရပါတယ်။
၂၈။ ယခုတရားရင်ဆိုင်မှုကို အသုံးချပြီး လူမျိုးသုဉ်းစေမှုဆိုင်ရာကွန်ဗင်းရှင်းနဲ့ မဆိုင်သော လိုရာဆွဲ အစီအစဉ်များဖြစ်သည့် “ရိုဟင်ဂျာ”ဆိုသော အမည်နာမကို တရားဝင်အသုံးပြုခွင့်ပြုရေး၊ ဘင်္ဂလားဒေ့ရှ်နိုင်ငံရှိ ဒုက္ခသည်စခန်းများတွင် ရောက်ရှိနေသူများကို မြန်မာနိုင်ငံသို့ ပြန်ရောက်သည်နှင့် အလိုအလျောက် နိုင်ငံသားပေးရန် တောင်းဆိုနေသည်ကို တွေ့ရှိရပါတယ်။
ဥက္ကဋ္ဌကြီးနှင့် ဂုဏ်သရေရှိတရားသူကြီးမင်းများခင်ဗျား
၂၉။ မြန်မာနိုင်ငံက တရားရုံးအနေဖြင့် ယခုအမှုကြားနာစဉ် ကာလအတွင်း လူမျိုးသုဉ်းစေမှုဆိုင်ရာ ကွန်ဗင်းရှင်း၏ ၁၉၄၈ ခုနှစ်တွင် အလေးထား ညှိနှိုင်းသဘောတူထားပြီးဖြစ်သော အဓိပ္ပာယ်ဖွင့်ဆိုချက်များနဲ့သာ ယှဉ်ထိုးသုံးသပ်ပြီး ယင်းတို့ထက် ပိုမိုဆောင်ရွက်ခြင်းမပြုပါရန်နဲ့ ဤကွန်ဗင်းရှင်းနဲ့ပတ်သက်၍ တရားရုံးက ကောင်းစွာ ဆုံးဖြတ်ဆောင်ရွက်ထားပြီးဖြစ်သော ဘော့စနီးယားနိုင်ငံနဲ့ ခရိုအေးရှားနိုင်ငံအမှုတို့တွင် လိုက်နာကျင့်သုံးခဲ့သော အမှု၏ စီရင်ထုံး ဥပဒေကိုသာ လိုက်နာရန် တင်ပြတောင်းဆိုလိုပါတယ်။ မြန်မာနိုင်ငံက တရားရုံးအနေဖြင့် သက်သေ အထောက်အထားများကို အသေးစိတ်ကြည့်ရှုစေလိုပြီး အချက်အလက်များကို တရားသူကြီးများ၏ ဆင်ခြင်တုံတရားနဲ့သာ ဆုံးဖြတ်စေလိုပါတယ်။ တရားရုံးအနေဖြင့် လွတ်လပ်စွာ၊ မျှတစွာ ဆောင်ရွက်မည်၊ သက်သေ အထောက်အထားများကို အထောက်အထားဆိုင်ရာ စည်းမျဉ်းများ အပါအဝင် ရှိရင်းစွဲဥပဒေစည်းမျဉ်းများနဲ့အညီ ယထာဘူတကျကျ သုံးသပ်မည်ဟု မြန်မာနိုင်ငံက ယုံကြည်ပါကြောင်း၊ မြန်မာနိုင်ငံသည် မြန်မာနိုင်ငံဆိုင်ရာ လွတ်လပ်သော အချက်အလက် စုဆောင်းရေးအဖွဲ့ (FFM)၊ မြန်မာနိုင်ငံအတွက် လွတ်လပ်သော စုံစမ်းစစ်ဆေးရေးယန္တရား (IIMM) တို့၏ ဘက်လိုက်မှုကို လက်မခံသကဲ့သို့ ဂမ်ဘီယာက အသုံးပြုသည့်အချက်အလက်များမှာ တိကျမှုနဲ့ ယုံကြည်စိတ်ချမှုရှိသည်ကို လက်မခံပါ။ သို့ဖြစ်ရာ တရားရုံးအနေဖြင့် သက်သေ အထောက်အထားများကို ကိုယ်တိုင်တွက်ဆပြီး အခြားအဖွဲ့ အစည်းများ၏ သုံးသပ်ချက်၊ ထင်မြင်ချက် အထူးသဖြင့် ခိုင်လုံသည့်သက်သေများ မဟုတ်ပါက ယုံကြည်ကိုးကားခြင်း မပြုစေလိုပါ။
၃၀။ တရားရုံးသည် နိုင်ငံများအချင်းချင်း ပဋိပက္ခများ ဖြေရှင်းရေးဆိုသည့် အလွန်အရေးကြီးသည့် အဓိကတာဝန်ကို ထမ်းဆောင်ပါတယ်။ အချို့က တရားရုံးကို ကမ္ဘာ့အလယ်တွင် နိုင်ငံရေးလှုပ်ရှားသည့် နေရာအဖြစ်အသုံးချပြီး ကြွားဝါခြင်း၊ အရေးပါကြောင်းပြသခြင်း သို့မဟုတ် စာချုပ်များ၏ အနှစ်သာရထက် စာချုပ်များကို နိုင်ငံရေးအကျိုးအမြတ်အတွက် အလွယ်တကူ အသုံးပြုနိုင်ရန် ဆောင်ရွက်ကြပြီး တရားရုံး၏ အဓိကတာဝန်ကို အထင်သေးကြပါတယ်။
၃၁။ သို့ဖြစ်ရာ တရားရုံးအနေဖြင့် ယခင်က တည်ဆောက်ခဲ့သည့်ဥပဒေများ၏ အရေးကြီးမှုကို သိရှိပြီး နိုင်ငံများပါဝင် အသုံးပြုနိုင်ရန်ရည်ရွယ်ချက်ဖြင့် စာချုပ်များထိရောက်‌အောင် ဆောင်ရွက်လေ့ရှိပါတယ်။ ယင်းအချက်မှာ အငြင်းပွားဖွယ်ရာမရှိပါ။ တရားဥပဒေစိုးမိုးရေးအတွက်လည်း အလွန် အရေးကြီးပါတယ်။ နိုင်ငံတကာအသိုက်အဝန်းကလည်း ပဋိပက္ခများဖြေရှင်းနိုင်ရေးအတွက် တရားရုံး အပါ် ယုံကြည်အားကိုးကြခြင်းဖြစ်ပါတယ်။

Esteemed President of the International Court of Justice, distinguished Vice-President, honourable Members of the Court,

1. As Agent of the Republic of the Union of Myanmar, it is with great solemnity that I stand before you to defend my country against the accusation of violating the Genocide Convention.
2. Myanmar fully recognises the fundamental importance of the Genocide Convention. Myanmar signed it in 1949, and ratified it in 1956. Myanmar’s presence in this Great Hall of Justice is a testimony of the importance of the Convention for my country. Today, we stand before the Court to defend the honour of our country against an accusation of the outmost gravity. A finding of genocide would place an indelible stain on my country and its people. These proceedings are of fundamental importance for my country’s reputation and future.
3. Myanmar treats the allegations, and this case, with utmost seriousness. As a sovereign State fully committed to the observance of international law, it has prepared its written pleadings with the care and attention to detail that would be expected of a response to such grave allegations being determined by the principal judicial organ of the United Nations. Myanmar has complied with all procedural rules and orders of the Court, including the provisional measures order. This demonstrates its commitment to the international rule of law and the role of the Court.
4. Unfortunately, the same cannot be said of The Gambia. The Gambia’s inquiries into facts are rudimentary and partisan, based on reports of the Fact-finding Mission from 2018 and 2019, which are neither reliable nor objective, and were a condemnation without trial of Myanmar.
5. The Gambia has additionally failed to present the evidence objectively. It has furthermore nurtured a dangerous mixing of roles, in which its representatives and its sources of evidence (the so-called independent NGOs and witnesses) are on the same bench. This is in no way helpful to the integrity of the proceedings and casts serious doubt on the quality of the material put before you. An accusation of genocide is too grave to be handled in such a haphazard and unprofessional manner.

Mr President, Members of the Court,

6. Myanmar’s firm position is that The Gambia has failed to meet its burden of proof. This case will be decided on the basis of proven facts, not unsubstantiated allegations. Emotional language and blurry factual pictures are not a substitute for rigorous presentation of facts. This is also a case about the proper interpretation of the law – which The Gambia distorts – largely ignoring your jurisprudence, as our counsel will show.
7. The Gambia no longer denies the terrorist attacks by ARSA which took place in northern Rakhine State in 2016 and 2017, or the need of a government response to those attacks. Obviously, Myanmar was not obliged to remain idle and allow terrorists to have free rein of northern Rakhine State. These attacks were the reasons for the “clearance operations”, which is a military term, referring to counter-insurgency or counter-terrorism operations.
8. It is true that, as a consequence of the clashes, people were killed, and a large number of people left the area and went to Bangladesh. As in other instances of armed conflict and instability throughout the world, and indeed, in other regions of Myanmar itself, such events will have had a huge impact on a large part of the region’s population. Myanmar is well aware of the human cost of armed conflict, instability and terrorism. There has been historically, and unfortunately still is, conflict in different regions of Myanmar. The Government aspires to peace throughout the country and is striving its utmost through dialogues, discussions, negotiations with all stakeholders.
9. However, the paths to peace are complex. When considering the narrow issues within the scope of these proceedings, the Court cannot make assumptions about such matters as the best ways forward, or about the aspirations of the Muslim population in northern Rakhine State. The Court cannot assume that those responsible for the terrorist attacks in 2016 and 2017 speak for them. Nor can the Court assume that any of the organisations involved in these proceedings speaks for them.
10. As a developing nation, Myanmar continues to face significant challenges arising from natural disasters such as earthquakes, floods, and storms as well as financial constraints, emergency situations, and ongoing internal instability. In this context, it has continuously taken steps to address the issues in northern Rakhine State. Details are given in Myanmar’s regular reports pursuant to the provisional measures order.

11. The Gambia says that Myanmar does not recognise the right to exist of the Muslim minority in northern Rakhine State, or the right of this population to be in Myanmar. That is untrue. Myanmar considers that Bengalis in northern Rakhine State are culturally, ethnically and religiously part of the same group as the population living immediately across the border in Bangladesh. However, Myanmar accepts that even if this is so, those living in northern Rakhine State would be a “part” of that group for purposes of the Convention. Conversely, even if the Court were to find that those living in northern Rakhine State are a protected group in their own right for purposes of the Convention, that would not of itself mean that their ethnicity, culture or religion is any different from that of those living in the immediately adjacent territory of Bangladesh. There is therefore no need for the Court to consider cultural, ethnic and religious comparisons between those living on the two sides of the border.
12. The Gambia also complains that Myanmar does not use the name “Rohingya” officially, and instead uses the name “Bengali”. There are, however, justifiable reasons for this. Furthermore, failure to use a particular name in no way implies that the population does not exist, or has no right to exist.
13. The Gambia also says that Myanmar does not recognize the members of this population as its citizens. Again, even if this were true, it would not mean that Myanmar has a genocidal intent. But in fact, many Bengalis do indeed have one or other of the three types of Myanmar citizenship. There are others who would be recognized as having one or another of the three types of citizenship if they were to make an application for such recognition. There are also some who are not entitled to any type of citizenship in Myanmar. Again, there are reasons for this.
14. The first step for a person making an application for citizenship is to apply for what is called a National Verification Card, or “NVC”. There are around two hundred thousand Bengalis holding citizenship cards across the country, and fifty thousand Bengalis holding NVCs in Rakhine State alone. Those who apply for an NVC and are found not to be entitled to citizenship can continue to live lawfully in Myanmar as holders of an NVC.
15. Despite this, many Bengalis in northern Rakhine State refuse to engage with the NVC process. Some refuse on political grounds. Some refuse because they are pressured by activists not to do so, or have received false information from activists that anyone who applies for an NVC will never be granted citizenship. All this has nothing to do with genocide.
16. Like in other States, the Myanmar Constitution gives equal rights to all Myanmar citizens. No one can be politically discriminated for their origin and belief. Section (391-A) of the Constitution allows all eligible citizens to vote in the election. As we speak, the multi-party general elections are underway in Myanmar starting from 28 December 2025. The elections are being held in three phrases, and all eligible voters regardless of ethnicity and religion came out to cast their votes. Fifty seven (57) political parties and four thousand eight hundred and sixty one (4861) candidates are contesting for various constituencies including Rakhine State. There are 154,049 Bengalis in Myanmar who are eligible to vote in the current elections.

17. Let me also be clear that Myanmar is committed to achieving the repatriation to Myanmar of persons from Rakhine State currently living in camps in Bangladesh.
18. There were two previous instances of mass migration from Myanmar to Bangladesh, in 1978 and 1991-1992 respectively. On both of those two previous occasions, Myanmar was able to successfully repatriate those concerned in accordance with agreements made through bilateral consultations with Bangladesh.
19. Likewise, following the events of 2016 and 2017, agreements were quickly made between Myanmar and Bangladesh for the return of the displaced persons from Rakhine State. Comprehensive measures to resettle and rehabilitate the returnees are also being put in place, such as providing security, education, healthcare, food and job opportunities, with international cooperation including from the United Nations. Since 2019, we have also had informal tripartite Working Groups and discussions on the repatriation process involving Myanmar, Bangladesh and China, at the senior official and vice-ministerial level. We have also invited diplomats, delegates of displaced persons themselves, as well as the media, to witness these comprehensive measures firsthand. In addition, we have a comprehensive plan for resettlement and rehabilitation of the returnees including a one-stop service for the issuance of NVCs and applications for citizenship, temporary livelihood supports, and shelters in transition, new settlement arrangements near original places, distribution of land use for farming, income generation programs, health and education facilities, etc.
20. Myanmar’s commitment and constant efforts since 2017 contradict The Gambia’s narrative that Myanmar’s intention is to destroy or forcibly deport this population.
21. However, although Myanmar had tried its utmost, there have unfortunately been setbacks to the repatriation process. These have included the COVID-19 pandemic from 2020 to 2022, Cyclone Mocha which hit the northern Rakhine area in 2023, and instability in Rakhine State. Circumstances not of Myanmar’s making have so far prevented the actual commencement of repatriations.
22. It will be seen on examination that these proceedings are in fact being used as a vehicle to advance agendas that have nothing to do with the Genocide Convention, such as demands that the name “Rohingya” be used officially, and that all of those currently living in camps in Bangladesh automatically be given citizenship of Myanmar upon being repatriated to Myanmar.

Mr. President, Members of the Court,

23. Myanmar does not have trust in the impartiality of the Independent International Fact-Finding Mission on Myanmar or of the Independent Investigative Mechanism for Myanmar, and does not accept the claimed accuracy or reliability of the information in their documents or in other documents relied on by The Gambia. It is therefore essential to Myanmar that the Court evaluate all of the detailed evidence itself, and not rely on opinions or conclusions expressed by any other bodies, especially if these are not based on first-hand evidence.
24. In these proceedings, Myanmar asks the Court to do no more than apply the terms of the Genocide Convention, as they were so carefully negotiated in 1948, and to follow its own case law which is now well established. Myanmar respectfully asks the Court to look very carefully at all of the evidence in detail, and to reach its own judgment of the facts. Myanmar is confident that the Court will act independently and impartially, and will consider the evidence fairly and objectively.

Myanmar appears at the International Court of Justice – The Gambia v. Myanmar
The Republic of the Union of Myanmar is appearing before the International Court of Justice (ICJ) in the merits hearing of “The Gambia v. Myanmar” showing thus its respect for international law and the judicial role of the Court.
Being a responsible member of the international community and a State party to the 1948 Convention on the Prevention and Punishment of the Crime of Genocide, Myanmar has maintained a sincere intention to cooperate with the Court in good faith since the initiation of this case in November 2019. Myanmar has participated in all stages of the proceedings, following every order of the court and engaging constructively with the judicial process. Myanmar has also taken steps to fully comply with the provisional measures indicated by the Court and has submitted periodic reports as required.
These proceedings are of the outmost importance for Myanmar, which has been accused of one of the gravest violations of international law. It is the duty of the Government to defend the honour of the country and its people and to show to the Court and to the world that biased reports, based on unreliable evidence, cannot make up for truth. Myanmar places its confidence in the wisdom, independence, and impartiality of the International Court of Justice.
We trust the Court will assess the evidence fairly and objectively, and reach its judgment based on fact and settled law strictly within the legal framework of the Genocide Convention. Starting this Friday, 16th January 2026 – after The Gambia’s first round presentation – Myanmar will present to the Court the many reasons why the allegations made by The Gambia are flawed and unfounded in fact and law. During the proceedings, Myanmar will refrain from arguing the case in public outside the Court, in particular before the international media. While expectations are high, it is important to protect the integrity of the judicial proceedings from any outside pressure or interference.
In parallel with this Court process, the Government of Myanmar is discharging its state responsibilities and duties by continuing to cooperate with Bangladesh and other international partners on humanitarian and displacement-related issues in northern Rakhine State. It will continue to do so, despite the difficult situation in northern Rakhine State.
In this context, Myanmar is committed to achieving the repatriation of the persons who were displaced from Rakhine State and are currently living in camps in Bangladesh. A bilateral agreement with Bangladesh was concluded for that purpose. Myanmar has also held discussions with the United Nations High Commissioner for Refugees on matters relating to the repatriation of displaced persons from Rakhine State, including cooperation under the tripartite Memorandum of Understanding with UNDP and UNHCR, and practical arrangements to facilitate safe, voluntary, and dignified returns where conditions permit.
Myanmar reiterates that the “The Gambia v. Myanmar” case before the International Court of Justice is a State-to-State legal process concerning the application and interpretation of an international treaty, the Genocide Convention, and is not a forum for political accusations. Myanmar will address the allegations before the Court in a systematic, factual, and legal manner. Myanmar remains committed to engaging with the Court respectfully and in good faith, and to upholding the rule of law in the international legal order.

The Embassy of the Republic of the Union of Myanmar in Pretoria has opened a Book of Condolence following the passing of His Excellency U Myint Swe, Pro Tem President of the Republic of the Union of Myanmar, who passed away on 7 August 2025. The book was opened from Saturday, 9 August, Sunday, 10 August, and Monday, 11 August 2025, from 10:00 am to 12:00 pm and 2:30 pm to 4:00 pm. His passing is a profound loss to his family and to the nation, leaving a deep void in the hearts of all who knew and respected him.

The Embassy expresses its heartfelt gratitude to the Heads of Mission, diplomats, and representatives of international organizations who signed the Book of Condolence and conveyed their messages of sympathy and solidarity. The support and expressions of compassion received have been deeply appreciated by the Embassy of Myanmar, reflecting the enduring spirit of friendship and international solidarity.

Pretoria, South Africa — Mr. Thein Min Htun, Chargé d’Affaires a.i. and Minister of the Embassy of Myanmar, received H.E. Ekapol Poolpipat, Ambassador-Designate of Thailand to the Republic of South Africa, during a courtesy call yesterday at the Myanmar Embassy in Pretoria.

During the meeting, Mr. Thein Min Htun highlighted the longstanding bilateral relations between Myanmar and South Africa, and discussed ways to further strengthen ties between the ASEAN Pretoria Committee and the host country. The two sides also exchanged views on the upcoming 58th ASEAN Day Reception and explored opportunities for closer cooperation between their respective embassies.

The Embassy of the Republic of the Union of Myanmar in Pretoria opened a Book of Condolence at the Residence of the Ambassador, No. 329, Julius Jeppe Street, Waterkloof, Pretoria, 0181, on Monday, 31 March 2025, and Tuesday, 1 April 2025, from 14:00 to 17:00 hrs, in remembrance of the lives lost and the destruction caused by the devastating earthquake that struck Myanmar on 28 March 2025.

The Embassy expresses its sincere gratitude to the Heads of Mission, diplomats, and representatives of international organizations who signed the Book of Condolence and conveyed their heartfelt messages of sympathy and solidarity during this period of national mourning.

The support and expressions of compassion received have been deeply appreciated by the Government and people of Myanmar, reflecting the strong spirit of international friendship and solidarity in these difficult times.

His Excellency U Myint Swe, Ambassador Extraordinary and Plenipotentiary of the Republic of the Union of Myanmar to the Republic of Ghana, attended the State Funeral for the late Mr. Kofi Annan, former Secretary-General of the United Nations, held in Accra, the Republic of Ghana, from 11 to 13 September 2018.

The funeral was attended by numerous Heads of State, senior government officials, and representatives from the international community who gathered to pay tribute to Mr. Kofi Annan’s distinguished service and lasting contribution to global peace and diplomacy.

His Excellency U Myint Swe, Ambassador Extraordinary and Plenipotentiary of the Republic of the Union of Myanmar to the Republic of Ghana, presented his Letters of Credence to His Excellency Mr. Nana Addo Dankwa Akufo-Addo, President of the Republic of Ghana, at a ceremony held in Accra on 17 July 2018.

On this occasion, His Excellency U Myint Swe conveyed the cordial greetings and best wishes of the Government and people of Myanmar to President Akufo-Addo and the people of Ghana. Both sides expressed their mutual desire to strengthen the existing friendly relations and cooperation between Myanmar and Ghana.

His Excellency U Myint Swe, Ambassador Extraordinary and Plenipotentiary of the Republic of the Union of Myanmar to the Republic of Zimbabwe, presented his Letters of Credence to His Excellency Mr. Emmerson Mnangagwa, President of the Republic of Zimbabwe, at a ceremony held in Harare on 19 June 2018.

On this occasion, His Excellency U Myint Swe conveyed the warm greetings and best wishes of the Government and people of Myanmar to President Mnangagwa and the people of Zimbabwe. Both sides expressed their willingness to promote friendship and cooperation between Myanmar and Zimbabwe in the years ahead.

His Excellency U Myint Swe, Ambassador Extraordinary and Plenipotentiary of the Republic of the Union of Myanmar to the Republic of Kenya, presented his Letters of Credence to His Excellency Mr. Uhuru Kenyatta, President of the Republic of Kenya, at a ceremony held in Nairobi on 8 December 2017.

On this occasion, His Excellency U Myint Swe conveyed the warm greetings and best wishes of the Government and people of Myanmar to President Kenyatta and the people of Kenya. Both sides expressed their commitment to further strengthening the friendly relations and cooperation between Myanmar and Kenya.
